Who is the administrator of my personal data?

The administrator of your personal data is METCHEM Sp. z o.o., ul. Konstytucji 3 Maja 10, 34-100, Wadowice, District Court for Kraków-Śródmieście in Kraków, Division XII Economic. Tax no. PL5491980819, National Business Registry no. 072143210, National Court Register no. 0000071497, hereinafter referred to as METCHEM.

What personal data does the Administrator process?

METCHEM, as the administrator of personal data within the meaning of the GDPR, processes in particular the following personal data:

  • Personal data of job candidates (data that candidates provide to the administrator in connection with participation in recruitment processes – in particular data contained in CVs)
  • Personal data of contractors and their representatives (company data* and contact persons – basic data used to issue and book invoices (name, tax identification number, business address) and for contact (name, surname, company name, job position, e-mail address , Phone number))
  • Persons sending inquiries via contact forms, e-mail and telephone (basic contact details (name, surname, e-mail address) provided by persons in connection with questions sent to the administrator)
  • People staying in the area of visual monitoring (video monitoring recordings)

*  – Company data are treated as personal data only in a situation where they allow the identification of persons concerning them. The data of capital companies are not treated as personal data.

On what terms does the Administrator process my personal data?

The rules for processing your personal data are presented below (in particular, who has access to them, how long they are stored and what are the grounds for their processing).

Personal data of job candidates

  • Purposes and grounds for data processing: Your personal data will be processed for the purposes of the recruitment process or also for the purposes of future recruitment processes if you give your consent (The basis for processing this data is the applicable legal regulations (in particular the Labor Code) and your consent)

  • Data recipients: These data may be made available to entities authorized under the law. Entities supporting METCHEM in the field of services and IT infrastructure may also have access to data on the basis of relevant agreements.

  • Storage period: Personal data processed by the administrator will be stored until the end of the recruitment process or until the withdrawal of your consent in the case of data processing for the purposes of future recruitment processes.

  • Transfer of data outside the EEA: METCHEM does not intend to transfer personal data to third countries (i.e. countries outside the European Economic Area) or to any international organizations.

  • Automated decision-making / profiling: METCHEM does not make decisions based on automated processing, including profiling (in relation to the purposes of data processing described above).

  • Voluntary / obligation to provide data: Providing personal data to the extent required by law, in particular the Labor Code, is obligatory, otherwise it is voluntary.

Personal data of contractors and their representatives

  • Purposes and grounds for data processing: Personal data of contractors will be processed for the purpose of implementing contracts concluded between the parties (pursuant to Article 6(1)(b) of the GDPR – processing is necessary for the performance of contracts to which you are a party) and fulfilling the obligations imposed on the administrator on the basis of applicable law (Pursuant to Article 6(1)(c) of the GDPR – processing is necessary to fulfill the legal obligation incumbent on the administrator (in particular with regard to issuing and storing VAT invoices), resulting, among others, from the Accounting Act and the VAT Act. Personal data of contractors’ representatives will be processed for contact purposes, including the purpose of establishing and maintaining business contacts (Pursuant to Article 6(1)(f) of the GDPR – the data controller’s legitimate interest in ensuring contact with the contractor and ensuring performance of contracts concluded with contractors) as well as for the purposes of fulfilling the obligations imposed on the administrator on the basis of applicable law (Art. 6 sec. 1 lit. c GDPR). Personal data of contractors and their representatives may also be processed for the purpose of possible investigation and defense of claims (The basis for data processing is Article 6(1)(f) of the GDPR – the legitimate interest of the data controller, which is the investigation and defense against claims).

  • Data recipients: This data may be made available to entities authorized under the law. Entities supporting METCHEM in the field of IT services (in particular hosting providers) may also have access to data on the basis of appropriate contracts.

  • Storage period: Personal data of contractors and their representatives will be stored for the period required under applicable law. Contact details of contractors’ representatives processed for the purposes of conducting business contacts will be stored until an objection to the processing of these data is raised.
  • Transfer of data outside the EEA: METCHEM does not intend to transfer personal data to third countries (i.e. countries outside the European Economic Area) or to any international organizations.
  • Automated decision-making/profiling: METCHEM does not make decisions based on automated processing, including profiling (in relation to the data processing purposes described above).
  • Voluntary nature/obligation to provide data: Providing personal data is voluntary, but necessary to conduct business contacts with METCHEM and implement contracts between the parties.

People sending inquiries via contact forms, e-mail and telephone

  • Purposes and basis for data processing: Personal data will be processed for the purpose of conducting electronic correspondence and implementing actions taken at your request (the basis for data processing is the legitimate interest of the data controller, which is conducting electronic correspondence and implementing actions taken at the request of data subjects).
  • Data recipients: This data may be made available to entities authorized under the law. Access to data on the basis of appropriate contracts may also be granted to infrastructure and IT service providers processing data on behalf of METCHEM.
  • Storage period: Personal data processed by the administrator will be stored for the period of electronic correspondence and then for archival purposes for the period specified in the administrator’s office instructions.
  • Transfer of data outside the EEA: METCHEM does not intend to transfer personal data to third countries (i.e. countries outside the European Economic Area) or to any international organizations.
  • Automated decision-making/profiling: METCHEM does not make decisions based on automated processing, including profiling (in relation to the data processing purposes described above).
  • Voluntariness/obligation to provide data: Providing personal data is voluntary, but necessary to exchange electronic correspondence or take action at your request.

People staying in the area of video monitoring

  • Purposes and basis for data processing: Your personal data will be processed for the purposes of ensuring the safety of employees and protection of the organization’s property (the basis for data processing is Article 6(1)(f) of the GDPR – the legitimate interest of the data controller which is to ensure the safety of employees and the protection of the organization’s property by using video monitoring)
  • Data recipients: This data may be made available to entities authorized under the law. Entities supporting METCHEM in the field of video monitoring, as well as security companies, may also have access to data on the basis of appropriate contracts.
  • Storage period: Your personal data (surveillance recordings) will be stored for a maximum period of 3 months from the date of recording. If the recording constitutes evidence in proceedings, it may be stored until the final conclusion of such proceedings.
  • Monitoring range: The video monitoring system covers the entire area of the company located in Wadowice at ul. Konstytucji 3 Maja 10 (34-100, WADOWICE), in particular hall interiors, building entrances, parking lots and adjacent areas, entry/exit from the Company’s premises. To a limited extent, monitoring may also cover the area adjacent to the Company’s premises.
  • Voluntary/obligation to provide data: Objection to recording prevents entry to the Company’s premises.
  • Automated decision-making/profiling: METCHEM does not make decisions based on automated processing, including profiling (in relation to the data processing purposes described above).

What rights do I have in connection with the processing of my personal data by METCHEM?

You have the right, as appropriate, to:

  • request access to your personal data, rectification, deletion and restriction of processing,

as well as to transfer your personal data;

  • withdraw your consent at any time. Withdrawal of consent does not affect the lawfulness of processing based on consent before its withdrawal.
  • object to the processing of your personal data
  • submit a complaint to the supervisory authority (PUODO – President of the Personal Data Protection Office)
